The Federal High Court in Abuja has returned to its registry for reassignment a fundamental rights enforcement suit filed by the detained self-styled Director-General of the Presidential Foreign Investment Promotion Council, Adeniyi Adeyemi.
The development occurred on Thursday when the matter came up before Justice Obiora Egwuatu.
The court declined to proceed with the hearing after observing that the 72-hour period earlier granted to the respondents to show cause why Adeyemi’s remaining reliefs should be granted had not yet expired.
Justice Egwuatu consequently directed that the case be returned to the court’s registry for reassignment.
Adeyemi, who has been detained over allegations connected with the activities of the organisation he purportedly headed, had approached the court seeking the enforcement of his fundamental rights.
The suit followed his detention and the legal actions surrounding his claim to be the Director-General of the Presidential Foreign Investment Promotion Council.
At the previous proceedings, the court had directed the respondents to respond to Adeyemi’s application within a specified period and explain why the reliefs sought by him should not be granted.
However, when the matter was called on Thursday, the court noted that the stipulated 72-hour period was still running.
The development means the substantive hearing of the remaining aspects of Adeyemi’s fundamental rights application will have to await further administrative steps and reassignment.
Further proceedings are expected to take place before the appropriate judge after the case is reassigned
